Thank you for choosing bakedbyAma! These Terms of Service ("Terms") represent the agreement between bakedbyAma ("bakedbyAma," "we," "us," or "our") and the customer ("you" or "your").

PLEASE READ THESE TERMS IN FULL BEFORE SUBMITTING PAYMENT.

By submitting the required retainer, making full payment, or otherwise confirming an order with bakedbyAma, you acknowledge that you have reviewed and accepted your order details, these Terms of Service, and the bakedbyAma Order Policies.

1. ORDER DETAILS & INVOICE APPROVAL

Before submitting payment, please carefully review your invoice and all accompanying order information, including, where applicable:

  • Event date

  • Pickup or delivery date and time

  • Cake or dessert size

  • Number of servings

  • Flavor

  • Filling

  • Design theme and style

  • Colors

  • Wording or inscriptions

  • Decorative elements

  • Inspiration photographs or attachments

  • Pickup or delivery arrangements

  • Pricing and applicable fees

The final invoice and accompanying written specifications reflect the order details agreed upon between bakedbyAma and the customer.

If any information is incorrect or does not reflect your request, you must notify bakedbyAma before submitting payment.

By submitting payment, you confirm your acceptance of the order specifications shown on the invoice unless otherwise agreed in writing.

2. AVAILABILITY & LEAD TIMES

All orders are subject to bakedbyAma's availability, production capacity, ingredient availability, and design requirements.

To allow adequate preparation time, customers are encouraged to submit inquiries at least:

  • Two (2) weeks in advance for birthdays, anniversaries, showers, graduations, and other celebration orders.

  • Three (3) weeks in advance for weddings, corporate orders, larger events, tiered cakes, and complex orders.

Earlier inquiries are encouraged for weekends, holidays, weddings, and larger events.

Service Area & Maryland Cottage Food Sales

bakedbyAma currently operates as a Maryland cottage food business. Orders produced and sold under Maryland's cottage food provisions are available for sale and distribution within the State of Maryland in accordance with applicable requirements.

Customers located outside Maryland may submit inquiries; however, acceptance of an order is subject to applicable laws and regulations governing where the order may be sold, delivered, or otherwise distributed.

Unless bakedbyAma confirms otherwise in writing, delivery of Maryland cottage food orders outside the State of Maryland is not available.

These lead times do not guarantee availability.

Submitting an inquiry, receiving a quote, or receiving an invoice does not reserve your event date.

Your order and event date are secured only after bakedbyAma accepts your order and receives the required retainer.

3. PRICING & QUOTES

Prices displayed on the bakedbyAma website, menu, social media, or other promotional materials are starting prices unless expressly stated otherwise.

Final pricing may vary based on factors including:

  • Cake or dessert size

  • Number of servings

  • Flavor and filling selections

  • Number of layers or tiers

  • Design complexity

  • Decorative elements

  • Specialty ingredients

  • Custom or personalized materials

  • Delivery

  • Rush service

  • Other requested customizations

Quotes are based on the information provided at the time they are prepared.

Changes requested after a quote or invoice has been issued may result in revised pricing.

4. RETAINER & ORDER CONFIRMATION

A 60% non-refundable retainer of the total order price is required to secure an accepted order and event date.

The retainer must be received within 24 HOURS after the invoice is issued unless bakedbyAma specifies otherwise.

Until the required retainer is received, your requested date remains available to other customers.

If payment is not received within the stated payment window, the invoice may expire and bakedbyAma may release the requested date without further obligation.

The retainer is non-refundable to the original payment method. However, qualifying cancellations, postponements, or rescheduling requests may be eligible for dessert credit as provided in these Terms.

5. FINAL PAYMENT

The remaining balance is due in full no later than two (2) calendar days before the scheduled event date.

bakedbyAma is not obligated to complete, release, or deliver an order with an outstanding balance.

Failure to submit final payment by the applicable deadline may result in suspension or cancellation of the order.

Payments already received will remain subject to the cancellation and dessert-credit provisions contained in these Terms.

For accepted rush orders or orders placed after the standard payment deadline, bakedbyAma may require full payment at the time of booking.

6. PAYMENT METHODS

Accepted payment methods and payment instructions will be provided on the customer's invoice or directly by bakedbyAma.

An order is not considered paid until the applicable payment has been successfully received.

Customers are responsible for submitting payment using the correct payment information provided by bakedbyAma.

7. CHANGES TO CONFIRMED ORDERS

Requests to modify a confirmed order are subject to bakedbyAma's approval, availability, and production schedule.

Changes may include:

  • Size or servings

  • Flavor or filling

  • Design

  • Colors

  • Decorations

  • Wording

  • Pickup or delivery arrangements

  • Event date

Approved changes may result in additional charges.

Once ingredients, personalized toppers, specialty decorations, custom materials, or other order-specific items have been purchased, ordered, prepared, or produced, certain changes may no longer be possible.

bakedbyAma reserves the right to decline requested changes that cannot reasonably be accommodated without affecting food safety, product quality, structural integrity, existing orders, or production capacity.

8. CANCELLATIONS

Because each order reserves production time and may require advance purchasing and preparation, payments are generally non-refundable to the original payment method, except where bakedbyAma expressly agrees otherwise or where required by applicable law.

Qualifying payments may instead be converted to dessert credit according to the following schedule.

Celebration Orders

For birthdays, anniversaries, showers, graduations, and similar celebrations:

14 or more days before the event:
100% of eligible payments made may be converted to dessert credit.

7–13 days before the event:
50% of eligible payments made may be converted to dessert credit.

Less than 7 days before the event:
No refund or dessert credit will be issued.

Weddings, Corporate Orders & Larger Events

21 or more days before the event:
100% of eligible payments made may be converted to dessert credit.

14–20 days before the event:
50% of eligible payments made may be converted to dessert credit.

Less than 14 days before the event:
No refund or dessert credit will be issued.

Custom-purchased materials, personalized items, non-refundable supplies, rush fees, and other nonrecoverable order-specific expenses are excluded from eligible dessert credit.

9. POSTPONEMENTS & RESCHEDULING

For purposes of these Terms:

Postponement means delaying an event when a new event date has not yet been determined.

Rescheduling means changing an existing order to a specific new event date.

Customers may request to transfer eligible payments to one (1) new event date, provided bakedbyAma receives at least:

  • Seven (7) days' notice for celebration orders.

  • Fourteen (14) days' notice for weddings, corporate orders, and larger events.

All rescheduling is subject to bakedbyAma's availability.

If bakedbyAma cannot accommodate the requested new date, the applicable cancellation and dessert-credit provisions will apply.

A second request to reschedule will be treated according to the applicable cancellation and dessert-credit policy unless bakedbyAma agrees otherwise in writing.

Rescheduled orders are subject to the menu, pricing, ingredient availability, and other conditions in effect for the new order.

Existing eligible payments will be credited toward the rescheduled order, and the customer is responsible for any additional balance.

10. DESSERT CREDIT

Qualifying dessert credit:

  • Is valid for twelve (12) months from the original event date

  • May be applied toward eligible future bakedbyAma orders

  • Is subject to bakedbyAma's availability

  • Is non-refundable

  • Is non-transferable

  • Has no cash value

  • Cannot be exchanged for cash

  • Is applied toward prices in effect when the future order is placed

If the new order exceeds the available credit, the customer is responsible for paying the difference.

If an eligible future order costs less than the available dessert credit, the unused balance may remain available until the original expiration date.

Unused dessert credit expires after the applicable twelve-month period.

11. RUSH ORDERS

Orders requested within seventy-two (72) hours of the scheduled pickup or delivery date are considered rush orders and are subject to availability.

Accepted rush orders are subject to a 25% rush fee, with a minimum charge of $30.

Rush fees are non-refundable once the order has been confirmed.

Acceptance of a rush order is at bakedbyAma's discretion and may depend on:

  • Design complexity

  • Ingredient availability

  • Specialty-material availability

  • Existing orders

  • Production capacity

Submitting a rush inquiry does not guarantee acceptance.

bakedbyAma may require full payment at the time an accepted rush order is confirmed.

12. DESIGN, COLORS & ARTISTIC DISCRETION

Customers are welcome to provide inspiration photographs, drawings, themes, color palettes, or other references.

These materials are used to communicate the customer's preferred design direction and do not guarantee exact replication of another cake or another artist's work.

Because bakedbyAma products are individually handcrafted, reasonable variations may occur in color, texture, piping, placement, decorations, floral arrangements, and other artistic details.

While reasonable efforts will be made to achieve requested colors, exact color matching cannot be guaranteed due to differences in food coloring, ingredients, lighting, photography, and digital displays.

bakedbyAma retains reasonable artistic discretion where necessary to preserve product quality, structural integrity, food safety, and the overall agreed design direction.

13. SERVINGS

Serving estimates provided by bakedbyAma are based on standard portion guidelines and are intended as estimates.

Actual servings may vary depending on how the cake is cut and portioned at the event.

Once the customer approves the cake size and serving estimate, bakedbyAma is not responsible for serving shortages caused by portions being cut larger than the recommended serving size or attendance exceeding the number of servings ordered.

Serving plates, utensils, cake-cutting supplies, and cutlery are not included unless expressly specified on the customer's invoice.

14. ALLERGIES, DIETARY REQUIREMENTS & HOME-KITCHEN DISCLOSURE

Customers are responsible for informing bakedbyAma of any known food allergies, intolerances, or dietary requirements before an order is confirmed.

bakedbyAma operates from a home kitchen where common food allergens are used, stored, or handled. These may include, but are not limited to, milk, eggs, wheat, soy, peanuts, tree nuts, and sesame, depending on the products and ingredients being prepared.

Because products containing different allergens may be prepared using shared equipment, utensils, preparation surfaces, and kitchen areas, allergen cross-contact is possible. Although reasonable sanitation and food-handling practices are followed, bakedbyAma cannot guarantee that any product is completely free from a particular allergen.

Customers with severe or life-threatening food allergies should carefully consider this information before placing an order. It is also the customer's responsibility to communicate relevant allergen information to anyone who will consume or serve the products.

Requests for dietary modifications or ingredient substitutions are subject to availability and bakedbyAma's approval. A dietary modification does not mean that a product has been prepared in an allergen-free environment unless bakedbyAma expressly states otherwise in writing.

Maryland Cottage Food Disclosure

bakedbyAma currently operates as a Maryland cottage food business. Products sold under Maryland's cottage food provisions are prepared in a home kitchen and will be packaged and labeled in accordance with applicable Maryland cottage food requirements.

Where required, products will display the following disclosure:

“Made by a cottage food business that is not subject to Maryland's food safety regulations.”

Additional product information, including applicable ingredient and allergen information, will be provided on product labeling as required.

Customers should contact bakedbyAma before placing an order if they have questions regarding ingredients, allergens, or dietary requirements.

15. DECORATIONS, FLOWERS & NON-EDIBLE ELEMENTS

Some designs may contain decorative or structural components that are not intended for consumption, including cake supports, dowels, wires, picks, ribbons, acrylic toppers, artificial flowers, floral components, or similar materials.

Customers are responsible for ensuring that non-edible components are removed where appropriate before serving.

Where fresh flowers, toppers, decorations, or other materials are supplied by the customer, venue, florist, or another third party, bakedbyAma is not responsible for the quality, safety, or suitability of those items.

bakedbyAma reserves the right to decline any customer-supplied decoration that we reasonably believe could compromise food safety, cake stability, or product quality.

16. PICKUP & DELIVERY

Pickup

Customers are responsible for collecting orders at the confirmed location and within the agreed pickup window.

Exact pickup information will be provided privately with confirmed orders.

Customers who anticipate being late should contact bakedbyAma as soon as reasonably possible.

If another individual collects an order on the customer's behalf, acceptance of the order by that person constitutes acceptance on behalf of the customer.

Delivery

Delivery is available only when confirmed by bakedbyAma and may be subject to additional fees.

Customers are responsible for providing accurate:

  • Delivery address

  • Venue information

  • Contact information

  • Access instructions

  • Delivery-time requirements

An authorized individual must be available to receive the order at the agreed location and time.

Delays or additional costs resulting from incorrect information, inaccessible venues, unavailable recipients, venue restrictions, or circumstances outside bakedbyAma's reasonable control may result in additional charges where reasonably applicable.

17. TRANSPORTATION, STORAGE & CAKE CARE

bakedbyAma will provide applicable cake-care instructions before or at the time of pickup or delivery.

Customers collecting their orders are responsible for providing appropriate transportation.

Cakes and desserts should generally be:

  • Placed on a clean, flat, stable surface

  • Transported in a cool, air-conditioned vehicle when appropriate

  • Kept away from direct sunlight and excessive heat

  • Kept off car seats, laps, or other uneven surfaces

  • Transported carefully to minimize sudden movement

Customers must follow any refrigeration, storage, setup, and serving instructions provided for their specific order.

Once an order has been transferred to the customer or their authorized representative, responsibility for transportation, handling, storage, setup, and environmental conditions transfers to the customer.

bakedbyAma is not responsible for damage or deterioration resulting from improper transportation, storage, handling, setup, weather exposure, venue conditions, or failure to follow provided care instructions.

18. PRODUCT QUALITY & CUSTOMER CONCERNS

Due to the custom and perishable nature of bakedbyAma products, completed orders generally cannot be returned.

Personal taste preferences, reasonable artistic variations, minor color differences, or reasonable differences between a handcrafted cake and an inspiration image do not automatically constitute product defects.

If you believe there is a significant issue with your order attributable to bakedbyAma, please contact us within twenty-four (24) hours of pickup or delivery and provide photographs and relevant details.

Where reasonably necessary to evaluate a quality concern, bakedbyAma may request that a reasonable portion of the affected product be retained and made available for inspection.

Any appropriate remedy will be determined after review of the circumstances and does not limit rights or remedies that cannot legally be waived under applicable law.

19. EVENTS BEYOND REASONABLE CONTROL

bakedbyAma's ability to fulfill an order may be affected by circumstances outside our reasonable control, including severe weather, transportation disruptions, power or utility failures, accidents, emergencies, illness, government restrictions, significant supply disruptions, or similar unforeseen circumstances.

If such an event prevents or materially affects fulfillment, bakedbyAma will make reasonable efforts to notify the customer and determine an appropriate solution based on the circumstances.

Depending on the situation, this may include modification, postponement, rescheduling, dessert credit, or an appropriate refund relating to an unfulfilled portion of the order.

20. PHOTOGRAPHY & PORTFOLIO USE

bakedbyAma may photograph completed cakes and desserts before pickup or delivery.

Unless otherwise agreed, photographs of bakedbyAma products may be used in our portfolio, website, social media, advertising, and other promotional materials.

This permission applies to photographs of our products and does not grant bakedbyAma unrestricted permission to publish photographs of customers, event guests, or other identifiable individuals.

Customers who have concerns regarding highly personal or identifying information incorporated into a cake design should notify bakedbyAma before the event.

21. CUSTOMER-PROVIDED INFORMATION

Customers are responsible for providing accurate information, including:

  • Names

  • Dates

  • Spelling

  • Wording

  • Addresses

  • Contact information

  • Serving requirements

  • Allergy information

  • Design specifications

bakedbyAma is not responsible for errors incorporated into an order when those errors directly result from incorrect information supplied or expressly approved by the customer.

22. PRIVACY & ORDER POLICIES

Personal information submitted through the bakedbyAma website, inquiry forms, communications, invoices, or ordering process will be handled in accordance with our applicable Privacy Policy.

The bakedbyAma Order Policies also form part of the ordering process and should be reviewed together with these Terms.

The customer is encouraged to review both documents before submitting payment.

23. GOVERNING LAW & SEVERABILITY

These Terms and orders placed with bakedbyAma are governed by applicable laws of the State of Maryland, except where applicable law requires otherwise.

If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will continue in effect to the fullest extent permitted by law.

Nothing in these Terms is intended to waive or limit any consumer right or remedy that cannot legally be waived.

24. CHANGES TO THESE TERMS

bakedbyAma may update these Terms periodically.

Updates will apply prospectively and will not ordinarily change the material terms applicable to an already confirmed order unless agreed by the customer or required by law.

The version of these Terms provided or made reasonably available when an order is confirmed will generally govern that order.

25. ACCEPTANCE OF TERMS

By submitting the required retainer, making full payment, or otherwise confirming an order with bakedbyAma, the customer acknowledges that they:

  1. Have reviewed their invoice and order specifications;

  2. Have had an opportunity to review these Terms of Service;

  3. Have had an opportunity to review the bakedbyAma Order Policies; and

  4. Agree to be bound by the applicable terms of the confirmed order.
